§21-943.
   
   The magistrate or justice of the peace to whom anything suitable to be
   used for gambling purposes, or furniture or equipment used in a place
   conducted in violation of this Act is delivered, as provided by law
   shall, upon the examination of the accused, or if such examination is
   delayed, or prevented, without awaiting such examination, determine
   the character of the thing so delivered to him and whether it was
   actually intended or employed by the accused or others in violation of
   the provisions of this article; and if he finds that it is of a
   character suitable to be used for gambling purposes, and that it was
   actually employed or intended to be used by the accused or others, in
   violation of the provisions of this Article, he shall so find and
   cause the same to be delivered to the sheriff to await the order of
   the district court. Provided, that any of the furniture or equipment
   susceptible of legitimate use, may be sold and the proceeds thereof
   placed in the court fund of said county, and that any money so found
   by the officers shall be placed in the court fund of the county.
