§3A-208.7.
A. It shall be unlawful for any person to:
1. Use or conspire to use any battery, buzzer, electrical or
mechanical device, or other device other than the ordinary whip for
the purpose of stimulating or depressing a horse or affecting its
speed at any time; or
2. Sponge the nostrils or windpipe of a horse for the purpose of
stimulating or depressing a horse or affecting its speed at any time;
or
3. Have in the possession of the person, within the confines of a
racetrack, stables, sheds, buildings, or grounds where horses are kept
which are eligible to race over a racetrack of any organization
licensee, any device other than the ordinary whip which may or can be
used for the purpose of stimulating or depressing a horse or affecting
its speed at any time; or
4. Have in the possession of the person with the intent to sell, give
away, or exchange any such devices.
B. Possession of such devices by anyone within the confines of a
racetrack, stables, sheds, buildings, or grounds where horses are kept
which are eligible to race over the racetracks of any organization
licensee shall be prima facie evidence of intention to use such
devices.
C. Any person who violates the provisions of this section, upon
conviction, shall be guilty of a felony and shall be fined not more
than Ten Thousand Dollars ($10,000.00) or be imprisoned for a period
of not more than ten (10) years or both said fine and imprisonment.
The Commission shall suspend or revoke the license of any person
convicted of violating the provisions of this section.
