§47-230.13.


§47-230.13.
   
   A. The Department of Public Safety and the Oklahoma Highway Patrol
   Division shall enforce the provisions of the Oklahoma Motor Carrier
   Safety and Hazardous Materials Transportation Act and the rules and
   regulations issued thereto.
   
   B. Provided however, no enforcement action against a motor carrier or
   other person pursuant to the provisions of this act shall be initiated
   by the Department or the Oklahoma Highway Patrol until such time as
   enabling legislation may be adopted following the filing of a report
   by the Department as provided in subsection C of this section.
   
   C. The Department shall, on or before 1 January 1987, compile and file
   with the State Archivist, the Speaker of the House of Representatives
   and the President Pro Tempore of the Senate, a report relating to
   motor carrier safety and the transportation of hazardous materials,
   which shall include recommendations for enforcement procedures and a
   list of proposed specific offenses with recommended penalties.
