§43A-4-103.1.
   
   The superintendent of any institution within the Department of Mental
   Health and Substance Abuse Services shall have custody and control of
   a patient within the institution during the period of time the patient
   is detained for observation or treatment or both, and shall be
   responsible for the care and treatment of the patient during the time
   the patient remains in the institution.
