§43A-2-207.
   
   The Commissioner, with the consent of the Board, may employ persons to
   assist in collecting the amount due the state for the care and
   treatment of patients, and may employ counsel to institute such
   actions or proceedings as he may deem proper to enforce the claim of
   the state for the care and treatment of a patient against such
   patient.
