§43A-2-208.


§43A-2-208.
   
   A. A superintendent of a state mental institution shall have completed
   at least three (3) years' previous administrative experience in a
   health care setting and possess the qualifications listed in paragraph
   1 or 2 of this subsection.
   
   1. Be a graduate of any of the following programs, licensed to
   practice medicine or osteopathy by the State of Oklahoma:
   
   a. A legally chartered college of medicine or university accredited by
   the Association of American Medical Colleges or the Council on Medical
   Education and Hospitals of the American Medical Association. The
   person should be a diplomate of the American Board of Neurology and
   Psychiatry or be similarly qualified, or
   
   b. A school or college of osteopathic medicine which is accredited by
   the Bureau of Professional Education of the American Osteopathic
   Association and should be eligible for certification by the American
   Osteopathic Board of Neurology and Psychiatry or be similarly
   qualified.
   
   2. A graduate of an accredited master of health administration or
   master of business administration program or equivalent program of
   instruction.
   
   B. The superintendent of each institution shall be its chief executive
   officer, subject to the regulations of the Department of Mental Health
   and Substance Abuse Services, and shall be directly responsible and
   accountable to the Commissioner of Mental Health and Substance Abuse
   Services for the overall operation of the institution. The
   superintendent shall:
   
   1. Maintain an effective supervision and inspection of all parts of
   the institution. The superintendent or his or her designee shall have
   examined the condition of each patient after that person's admission
   to the institution and shall visit all the wards and patient units, at
   such times as the rules and regulations of the Department shall
   prescribe and at such other times as the superintendent shall deem
   necessary.
   
   2. Appoint, with the approval of the Commissioner, heads of
   departments and as many other assistants and attendants as the
   superintendent may think necessary and proper for the economical and
   efficient performance of the business of the hospital, and prescribe
   their duties and places, and fix, with the approval of the
   Commissioner, their compensation and discharge any of them at his sole
   discretion; but in every case of discharge the superintendent shall
   forthwith record the same, with the reasons under an appropriate head,
   in the files of the institution.
   
   3. Prescribe rules and give such orders for the management and
   operation of the institution in order to ensure efficient, economical
   and humane management and see that they are enforced.
   
   4. Pay special attention to the physical well-being of the patients.
   
   5. Maintain salutary discipline among all who are employed in the
   institution and enforce strict compliance with his instructions and
   uniform obedience to all rules and regulations of the institution and
   the Department of Mental Health and Substance Abuse Services within
   the statutory guidelines established by law for the State System of
   Personnel Administration and the State Ethics and Merit Commission.
   
   6. Establish and supervise adequate courses of instruction for the
   training of attendants and nurses under the rules and regulations of
   the Department.
   
   7. Cause full and fair accounts and records of all the
   superintendent's activities and of the entire business and operations
   of the institution to be kept regularly from day to day, in books
   provided for that purpose, in the manner and to the extent prescribed
   by law and regulation of the Department.
   
   8. See that all such accounts and records are fully made up to the
   last day of June of each year, and that the principal facts and
   results with his report thereon be at that time presented to the
   Commissioner.
   
   9. Admit any member of the Board or the Commissioner, or any person
   authorized by the Commissioner, into any part of the institution and
   exhibit to that person, or them, on demand, all the books, papers,
   accounts and writings belonging to the institution or pertaining to
   its business, management, discipline or government and furnish copies,
   abstracts and reports whenever required by the Board or the
   Commissioner.
   
   10. Maintain records in which the superintendent or his or her
   designee shall cause to be entered at the time of reception of any
   patient, the patient's name, residence, and occupation, and the date
   of such reception, by whom brought and by what authority, and on whose
   petition the admission was directed, and have all the orders,
   warrants, requests, certificates and other papers accompanying the
   patient forthwith filed within three (3) days after the reception of a
   patient, make, or cause to be made, a descriptive record of the case,
   and shall make, or cause to be made, entries from time to time, of the
   mental state, bodily condition and medical treatment of such patient
   during the time such patient remains under the institution's care, and
   in the event of the release or death of such person, the
   superintendent shall state in such case record the circumstances
   thereof, and make such other entries at such intervals of time and in
   such form as may be required by the Commissioner. If a patient is
   permitted to leave the institution, the record shall show whether or
   not the patient has been discharged or has been released to relatives
   or friends or is on a convalescent leave or a visit. Such record shall
   be accessible only to the superintendent and such officers and
   subordinates of the institution as the superintendent may designate,
   to the Commissioner and his representatives, except on the consent of
   the Commissioner or an order of a judge or a court of record.
   
   11. Report to the district attorney of the county in which the
   institution is located, any attendant, employee, or physician who
   shall willfully or maliciously assault, beat, batter, abuse or use
   mechanical restraint upon patients without authority or who shall aid,
   abet, advise or permit any patient confined in his institution to be
   subjected to such conduct.
   
   12. Hold staff meetings with the heads of the several departments of
   the institution at least once a week.
   
   13. Superintendents of State Mental Institutions may make available
   pertinent extracts of a case record of former patients to community
   health services, community social agencies and private physicians,
   provided such services, agencies or physicians are engaged in a
   therapeutic endeavor with such former patient. The recipient shall
   keep such information confidential as to individual patients. Further,
   such information can only be furnished by the superintendent within
   rules and regulations established by the Department of Mental Health
   and Substance Abuse Services.
