§43A-2-217.
   
   Any officer or employee in the Department of Mental Health and
   Substance Abuse Services who shall sell anything to any institution
   within the Department or who shall make any contract in which he is
   personally interested with such institution or who shall accept any
   gift or fee for any purpose from any person who has at the time or has
   had a contract to do anything connected with the Department or any of
   its institutions shall be guilty of a felony and, upon conviction,
   shall be fined not to exceed One Thousand Dollars ($1,000.00) or
   confined in the State Penitentiary not to exceed five (5) years, or
   both.
