§43A-7-108.
   
   Any person who takes a patient who has been lawfully admitted thereto
   from any institution within this department without the consent of the
   superintendent, or who entices, assists or encourages any such patient
   to escape therefrom shall be guilty of a misdemeanor and, upon
   conviction, shall be fined not to exceed One Thousand Dollars
   ($1,000.00) or confined in jail not to exceed one (1) year, or both.
